Batkivshchyna Party Leader Yulia Tymoshenko says the decision of the Sixth Administrative Court of Appeal declaring illegal the increase in gas prices for the population in 2016 now allows consumers to apply to competent authorities or the court to recalculate tariffs for gas and heat.
“Today, the second appellate court upheld the court’s decision that the government’s gas tariffs were unlawful, unwarranted and too high. This means that we were right in fighting against raising gas prices,” Yulia Tymoshenko said on the program “Freedom of Speech” on ICTV channel.
The politician also referred to the position of the legal community, according to which if the government unjustly, unlawfully and unjustifiably set the price for gas, then people “have the right to reimbursement through the court if they were wrongfully billed.”
“For 2.5 years people were charged the wrong price for gas, and people have the right through the court to be reimbursed what they were illegally overcharged,” said Yulia Tymoshenko.
On Monday, July 8, the Sixth Administrative Court of Appeal upheld the decision of the District Administrative Court in Yulia Tymoshenko’s lawsuit against the Cabinet of Minsters and Naftogaz of Ukraine, thus confirming the illegality of Resolution of the Cabinet of Ministers of Ukraine № 315 of April 27, 2016, which set the procedure for the formation of natural gas prices for the population and thermal communal power companies.
